Federal workers' union files suit over government shutdown pay

With a government shutdown looming but not yet a certainty, the largest union representing federal and District of Columbia government workers filed a lawsuit on Friday against the Obama administration, arguing that ordering federal employees to work during a shutdown without a pay guarantee is unconstitutional.

The American Federation of Government Employees, which represents more than 600,000 employees, argues in documents filed with the D.C. District Court that the government is violating the appropriations clause and the Thirteenth Amendment to the Constitution.


Hundreds of thousands of federal employees will be required to work during a shutdown, and there’s no guarantee that Congress will keep the administration’s promise to pay those employees once the shutdown is over,” John Gage, the union’s president, said in a statement.

By requiring employees deemed “essential” or “excepted” to work during a shutdown though Congress has not appropriated the funds to pay them, AFGE argues in its suit, the government is violating the appropriations clause. Requiring employees to work without a guarantee of pay, the union contends, is a violation of the constitutional amendment that was crafted to end slavery and involuntary servitude.

The suit names Office of Management and Budget Director Jack Lew and Office of Personnel Management Director John Berry as defendants.
